This Disclaimer Policy governs the liability limits of Kwikk Media and Software Solutions. By using our hosted SaaS systems, mobile creator app, or templates, you accept and agree to these standard liability exemptions.
1. No Business or Service Completion Guarantee
Kwikk Media functions exclusively as a SaaS marketing platform, providing digital design, hosting, and profile construction tools (including Digital Visiting Cards, Mini Websites, Digital Catalogs, and Professional Websites) to empower business owners.
Kwikk Media is not a party to, and strictly disclaims any liability for, the commercial transactions, pricing, quality of work, service fulfillment, or financial commitments agreed upon between hosted page owners (sellers) and their end-buyers. All transactions, agreements, and disputes are strictly between the individual parties involved.
2. Financial Payments & Gateway Disclaimers
Kwikk Media does not process, manage, store, or guarantee any financial transactions or payments made through customer Hosted Products (such as client Mini Websites or catalogs).
Any disputes regarding transaction settlements, refunds, chargebacks, financial losses, or credit card scams are strictly between you, your clients, and the respective payment gateway providers. Kwikk Media does not maintain access to client gateway API credentials or transaction records, and shall not be held liable for payment issues.
3. External Third-Party Links & Media Disclaimer
Hosted Product owners are solely responsible for ensuring that all user-uploaded logos, banner graphics, descriptions, YouTube videos, and external hyperlinks included on their hosted profiles do not infringe on any third-party intellectual property or violate any laws.
Kwikk Media does not actively pre-screen or guarantee the accuracy, safety, or legitimacy of user-posted content. We are not liable for trademark infringement, copyright claims, or disputes arising from malicious external links placed on hosted assets. We will enforce immediate content removal upon receiving verified DMCA or abuse reports.
4. Technical Uptimes & Telecom Interruption
While Kwikk Media deploys stable hosting networks and security modules, we cannot guarantee absolute, uninterrupted protective coverage against hacking, distributed denial of service (DDoS) attacks, phishing mirrors, or malware injection.
We are not responsible for hosted profile service disruptions, link downtimes, data loss, or server malfunctions caused by events outside our reasonable control (Force Majeure), including natural disasters, internet service provider outages, cloud server crashes, domain registrar failures, or telecom grid restrictions.
5. Phone & Operating System Specific Errors
Any hardware malfunction, OS system conflicts, or device-specific performance glitches cannot be attributed to the Kwikk Media Mobile Application.
Kwikk Media is not responsible for phone battery drain, background memory conflicts, local internet connectivity issues, hardware crashes, or software incompatibility arising from custom ROMs or third-party background application configurations running on your physical device.
